§ 1 Applicability, Definitions
(1) English 4 Professionals English Teaching GmbH, 1120 Vienna, Ratschkygasse 22/2/23, Austria (hereinafter referred to as “we” or “https://www.english4professionals.at/“) operates an online shop for services on the website https://www.english4professionals.at/. The following general terms and conditions apply to all services provided by us to our customers (hereinafter referred to as “customer” or “you”) in their current version at the time of the order, unless expressly agreed otherwise.
(2) “Consumer” within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity. “Entrepreneur” is a natural or legal person or a legal partnership with legal capacity that acts in the course of its commercial or self-employed professional activity, with a legal partnership being a partnership with the capacity to acquire rights and incur liabilities.
§ 2 Formation of Contracts, Storage of Contract Text
(1) The following provisions regarding the conclusion of contracts apply to orders through our online shop at https://www.english4professionals.at/.
(2) Our product representations on the internet are non-binding and not a binding offer to conclude a contract.
(3) When an order is placed in our online shop, the following regulations apply: The customer submits a binding contract offer by successfully completing the order procedure provided on our online shop. The order is placed in the following steps:
Filling out the order form
Entering/checking address and contact information and accepting the terms and conditions, data protection, and revocation policy,
Completing the order by clicking the “Pay Now with Credit Card” button. This constitutes your binding order.
The contract is concluded when you subsequently enter your credit card number and submit the form.
(4) In the event of the conclusion of the contract, the contract is concluded with English 4 Professionals English Teaching GmbH, 1120 Vienna, Ratschkygasse 22/2/23, Austria.
(5) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., the browser’s “Back” button). They can also be corrected by prematurely canceling the ordering process, closing the browser window, and repeating the process.
(6) The processing of the order and the transmission of all information required in connection with the conclusion of the contract are carried out by email, in part automatically. Therefore, you must ensure that the email address you have provided to us is accurate, the receipt of emails is technically ensured, and especially not prevented by SPAM filters.
§ 3 Subject Matter of the Contract and Essential Characteristics of the Products
(1) The subject matter of the contract in our online shop is:
The provision of services. You can find the specific services offered on our product pages.
(2) The essential characteristics of the services can be found in the product description. If the agreed quality of the goods deviates from their usual quality and conditions of use, this is expressly indicated in the product description (negative quality agreement). To the extent that the customer has given express consent to the deviation in quality, this defines the subject matter of the contract.
§ 4 Prices
(1) The prices quoted in the respective offers are total prices and include all price components, including all applicable taxes.
(2) The respective purchase price is to be paid before the product is delivered (prepayment), unless we expressly offer purchase on invoice. The payment methods available to you are indicated by a corresponding button in the online shop or in the respective offer. Unless otherwise stated for the individual payment methods, the payment claims are due for payment immediately.
(3) Delivery is worldwide.
§ 5 Right of Withdrawal
As a consumer, you have a right of withdrawal. The consumer agrees that the performance of the contract will begin immediately, within 14 days of the order, and waives the 14-day right of withdrawal.
§ 7 Language of the Contract
The contract language is exclusively German.
§ 8 Liability
(1) Subject to the exceptions set out below, our liability for breaches of contractual obligations and for tortious acts is limited to intent or gross negligence. The provider is not liable for the failure to achieve specific learning objectives or results.
(2) In case of slight negligence, we shall be liable without limitation in the event of the breach of life, body, health, or the violation of essential contractual obligations. If we are in default with the performance, if performance has become impossible, or if we have violated an essential contractual obligation, liability for resulting material and financial damages is limited to the typically foreseeable damage. An essential contractual obligation is one whose fulfillment is necessary for the proper execution of the contract, whose violation endangers the achievement of the contract purpose, and on whose compliance you can regularly rely. This includes in particular our duty to act and the fulfillment of the services owed under the contract, as described in § 3.
Offer valid only for the first 10 applicants each week. Week begins at 00:01 each Monday.
§ 9 Warranty
(1) The warranty is based on the statutory provisions.
(2) In relation to entrepreneurs, the warranty period for delivered goods is 12 months.
(3) As a consumer, you are requested to promptly check the service provided for completeness upon performance of the contract and to report any complaints as soon as possible. Failure to do so will not affect your statutory warranty rights.
§ 10 Final Provisions/Dispute Resolution
(1) Austrian law applies. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country of the consumer’s habitual residence (favorability principle).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods explicitly do not apply.
(3) If the customer is an entrepreneur, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider’s registered office.
